1 - INTRODUCTION

These Terms and Conditions govern your access to and use of the ATHLEG website, products, services and related content. By accessing this website, placing an order or purchasing an ATHLEG product, you acknowledge that you have read, understood and agreed to be bound by these Terms and Conditions.

ATHLEG products are designed in Australia and manufactured by our production partners in China to ATHLEG specifications for distribution within Australia and other approved markets.

If you do not agree with these Terms and Conditions, you should discontinue use of the website and refrain from purchasing ATHLEG products.

2 - PRODUCT INFORMATION

ATHLEG makes reasonable efforts to ensure that all product descriptions, specifications, pricing information and other content published on this website are accurate and up to date.

Product images are provided for illustrative purposes only. Actual products may vary in appearance, colour, packaging, materials or design due to manufacturing improvements, supplier updates or production variations.

ATHLEG reserves the right to modify product specifications, packaging, included accessories or product design without prior notice where such modifications do not materially affect the intended functionality of the product.

3 - ORDERS

All orders are subject to acceptance and availability.

ATHLEG reserves the right to reject, refuse, limit or cancel any order at its sole discretion, including where stock shortages, pricing errors, technical issues, suspected fraudulent activity or payment verification concerns arise.

An order confirmation email does not constitute acceptance of an order. Acceptance occurs only when the purchased product has been dispatched.

4 - PRICING

All prices displayed on the ATHLEG website are listed in Australian Dollars (AUD) unless otherwise stated.

ATHLEG reserves the right to amend pricing at any time without notice.

While every effort is made to ensure pricing accuracy, occasional errors may occur. In the event of an obvious pricing error, ATHLEG reserves the right to cancel the affected order and issue a full refund of any monies paid.

5 - SHIPPING & DELIVERY

ATHLEG will make reasonable efforts to dispatch products within advertised timeframes.

Delivery estimates are provided as a guide only and are not guaranteed.

ATHLEG shall not be liable for delays caused by freight providers, customs authorities, weather events, natural disasters, industrial action, government actions, public holidays or any circumstance beyond its reasonable control.

Customers are responsible for providing accurate delivery information. ATHLEG accepts no responsibility for delays, losses or additional costs arising from incorrect shipping information supplied by the customer.

Risk in the goods passes to the purchaser upon successful delivery to the nominated delivery address.

6 - DAMAGED OR INCORRECT DELIVERIES

Customers must inspect products promptly upon delivery.

If a product arrives damaged, defective or incorrect, customers must notify ATHLEG within seven (7) days of delivery and provide clear photographic evidence of the issue, including photographs of the packaging where relevant.

Where ATHLEG reasonably determines that damage occurred during transit or that an incorrect item was supplied, ATHLEG may, at its sole discretion replace the product.

Claims submitted outside the notification period may not be accepted.

7 - RETURNS, REPLACEMENTS & WARRANTY CLAIMS

ATHLEG products are designed for regular athletic recovery use and should be handled with reasonable care.

Particular attention should be given to the air hoses, connectors and controller connections, which form an essential part of the recovery system. Damage resulting from excessive force, improper handling, accidental damage, unauthorised modification or misuse is not covered under this policy.

If a product arrives damaged or develops a fault during normal use within the warranty period, customers must contact ATHLEG promptly and provide photographs and a description of the issue.

Where ATHLEG determines that a manufacturing defect or covered fault exists, ATHLEG will provide a replacement product at its discretion.

Customers may be required to return the affected product before a replacement product is dispatched. Returned products remain the responsibility of the customer until safely received by ATHLEG.

ATHLEG reserves the right to inspect returned products to determine whether the issue resulted from a manufacturing defect, normal wear and tear, accidental damage, misuse or other excluded causes.

Products showing evidence of excessive wear, abuse, improper storage, accidental damage, unauthorised repair attempts or use inconsistent with the product instructions may not qualify for replacement under this policy.

8 - WARRANTY COVERAGE

ATHLEG products are covered by a twelve (12) month limited warranty against defects in materials and workmanship under normal intended use.

This warranty applies to faults affecting the controller, battery system, pump, compression chambers, hoses and connectors where such faults arise from manufacturing defects or component failure during normal operation.

The warranty does not cover:

• • accidental damage;
  • punctures, cuts or tears;
  • damage caused by improper handling;
  • damage caused by excessive force applied to hoses or connectors;
  • water damage;
  • unauthorised modifications or repairs;
  • cosmetic wear resulting from ordinary use;
  • normal wear and tear over time.

ATHLEG products are intended to provide reliable long-term performance when used and maintained in accordance with the supplied instructions.

9 - PRODUCT USE & HEALTH INFORMATION

ATHLEG products are intended for general wellness, recovery and athletic recovery applications only. ATHLEG products are not intended to diagnose, treat, cure or prevent any disease, injury or medical condition.

Customers should consult an appropriately qualified healthcare professional before using ATHLEG products if they are pregnant, have circulatory disorders, cardiovascular conditions, recent surgical procedures or any other medical condition that may be affected by compression therapy.

Users assume all responsibility for determining whether ATHLEG products are appropriate for their individual circumstances.

10 - LIMITATION OF LIABILITY

To the fullest extent permitted by law, ATHLEG excludes liability for indirect, incidental, consequential, special or punitive damages arising from the use of the website or ATHLEG products.

ATHLEG’s total liability shall not exceed the purchase price paid for the affected product.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot legally be excluded under Australian Consumer Law.

11 - INTELLECTUAL PROPERTY

All content appearing on the ATHLEG website, including logos, graphics, photographs, product names, text, designs, trademarks and other intellectual property, remains the exclusive property of ATHLEG unless otherwise stated.

No content may be copied, reproduced, distributed, modified or used without prior written permission from ATHLEG.

12 - GOVERNING LAW

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Queensland, Australia. Any dispute arising from these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of Queensland Australia.

13 - CHANGES TO THESE TERMS

ATHLEG reserves the right to amend these Terms & Conditions at any time.

Updated versions will be published on this website and become effective immediately upon publication.
